Australian top Court said. The issue came into light when a 49 year old man came to court claiming that the mother of his child is leaving for NewZealand with her husband and the child. While the child's mother claimed that he was not the child's father as he had just donated the sperms while the child is legally hers.

The couple had been friends when the man donated his semen to the lady. They gradualy fell in love and brought up the child together. However, the lady later fell in love with other man wanted to take her child away to New Zealand along with her new partner.

The man had finally been eleated after 5 years when the court declared that the sperm donor would be recognised as the legal father of the child. the court in its judgement said that the biological father could be called a sperm donor only when he is not involved in the life of the child and is just a part of the procedure. But the case here is not so. The man also has his name on the child's birth certificate while the child also denotes him as her 'Daddy.' The court thus, ruled that the man would be the legal father of the child in this case.
